Terms & Conditions

This Agreement ("Agreement") is entered into by and between Nano Training ("We," "Us," or "Our") and the individual accepting these terms and conditions ("You," "Your," or "the Student"). By accepting these Terms and Conditions and paying the Course Fee, You agree to be legally bound by the terms of this Agreement. The Agreement is formed when You click to accept these Terms and Conditions or make the payment, whichever occurs first.

Through acknowledging these terms and conditions, you and Nano Training have entered into a legally binding agreement.

You agree to pay the course charge ('Course Fee') for the Course you have chosen under this Student Contract ('Course') by accepting these conditions. Nano Training intends, following receipt of the Course Fee, to:

Any resources not mentioned as Course Materials for your Course are not covered by the Course Fee. You may need to bring personal equipment in addition to the Course Materials at your own expense, according to Nano Training. Nano Training will give you a Certificate for your Course if you complete all assignments successfully, pay the Course Fee in total, and pay the certificate fees.

As you progress through the Course and submit your assignments, you will have access to course materials. If you refuse to pay any portion of the Course Fee when it becomes due, Nano Training reserves the right to withdraw the availability of Course Materials. You must deliver the total payments on or before the due date if you are paying by instalments.

If you do not pay any instalment by the due date, the complete outstanding balance of the Course Fee will become instantly due and payable, regardless of your progress through the Course.

Payment and Fees

The "Course Fee" covers the provision of Course Materials, evaluation and marking of assignments, and access to tutor support as outlined in the course description. VAT is included in the Course Fee unless otherwise stated. If paying by instalments, You must ensure timely payment of each instalment. Failure to do so may result in the immediate withdrawal of access to Course Materials, and the outstanding balance of the Course Fee will become due immediately. We reserve the right to charge interest on overdue payments at the rate of 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

Cancellation & Refund Policy

We shall make the digital content accessible as soon as we approve your order. Although you have 14 calendar days from the date on which the purchase contract is concluded to cancel your purchase of the Course within this policy. It is known as the Cancellation Period. Once payment is received, and products have been delivered to the student’s dashboard or accessed, refunds are not available. This does not affect your statutory rights.

Suppose you redeem your voucher during the Cancellation Period. In that case, you explicitly request that we immediately send course materials to you, and you agree that you forfeit your right to cancel the Course purchase and receive a refund. Note: All coupons for external exams must be used within six months after purchase.

Even though Nano Training strives to provide the best prices, because some courses are sourced from outside sources, our prices may occasionally be higher than those of our suppliers. You will not be eligible for a refund if you purchased one of our courses and later discovered it was cheaper elsewhere.

It is your obligation to confirm that the Course is appropriate for you before purchasing it from us. Our website provides relevant information about all of the courses and previews for some of them. However, it should be emphasised that not having access to a demonstration does not imply cancellation rights.

The comprehensive course information is intended to lessen the chances of you making a mistake. Examine the course description as well as the technical specifications. Check that the Course will run on your PC and that you are comfortable with the depth and style of the Course by accessing the sample course (if available).

You can speak with one of our training consultants to learn more about the courses and validate the information you've seen on the website so you can make an informed decision about which Course best meets your needs.

Please be aware that because some of the courses are sourced by us, you will be expected to respond to a communication from one of our providers to access the course(s) you have acquired. Besides that, please be aware that while Nano Training can usually assist with any course access or user issues, in rare cases, we may need to contact our third-party developers on your behalf, which could take up to 7 to 10 working days to resolve.

'Deposit' is a word that has a lot of different meanings. You should be aware that a deposit is only a portion of the service's total cost (Course in our case). Once you put down a payment, you indicate that you want to buy a course and sign a contract with us. Please keep in mind that fees are non-refundable unless you have statutory protection and we are satisfied that you have met all of the conditions.

How long would it take for my refund to be processed?

A refund will take up to 14 business days to process. To exercise Your right to cancel, You must contact Us within the Cancellation Period. This does not affect Your statutory rights, including the right to a refund for faulty content.

Exams & Certificates

Exam vouchers will be issued in response to your exam scheduling request. Exam vouchers all have an expiration date, which is calculated from the date of purchase. Before completing a purchase, please review the website and, if you have any more questions, please get in touch with one of our training consultants by dialling one of our company numbers.

External exams are an additional fee to students because they are a commercial event outside of Nano Training, and we have no influence over their rates.

On request, course accomplishment certificates can be emailed for a small fee.

Prior to booking or taking the exam, the delegate must check that they meet the course and exam prerequisites. If you are unsure, don't hesitate to contact our customer service team, who would be pleased to help.

It is not possible to transfer the Course to another person.

The Course Materials provided by Nano Training will become your property. The content of the Course Materials, including copyright and all other intellectual property rights contained therein, remains the property of Nano Training or a designated third party. Without Nano Training's prior written permission, you may not copy any element of the Course Materials. You must not copy or download any of the videos offered to you to aid your learning, as these materials remain the copyright of Nano Training or a designated third party and can only be accessed through Nano Training's resources.

Plagiarism is not tolerated at Nano Training. Nano Training has the right to dismiss you from the Course if there is proof of plagiarism in any of your assignment submissions. You must not copy or download any of the videos offered to you to aid your learning, as these materials remain the copyright of Nano Training or a designated third party and can only be accessed through Nano Training's resources.

Students enrolled in the Certificate Program have up to 12 months to finish their studies. Students enrolled in the Diploma Program have up to 12 months to complete their courses. If necessary, additional extensions are allowed; however, Nano Training has the right to charge a fee for extensions. Nano Training takes no liability if any third-party offers or discounts are revoked by the third-party provider. Intellectual Property and License

You are granted a limited, non-exclusive, non-transferable license to use the Course Materials solely for personal educational purposes. All copyright and other intellectual property rights in the Course Materials remain the property of Nano Training or the designated third-party licensors. You may not copy, reproduce, distribute, or create derivative works from the Course Materials without Our prior written consent. Unauthorized use of Course Materials may result in termination of Your access to the Course and legal action.

Termination and Withdrawal of Service

Nano Training reserves the right to terminate this Agreement and withdraw Your access to the Course if You breach any term of this Agreement, including but not limited to non-payment, unauthorized use of Course Materials, or plagiarism. In the event of termination, You will remain liable for any outstanding payments.

Limitation of Liability

Nothing in these Terms and Conditions shall limit or exclude Our liability for death or personal injury caused by Our negligence, fraud, or any other liability that cannot be excluded or limited by law. Subject to the foregoing, Our total liability to You in respect of all other losses arising under or in connection with this Agreement shall not exceed the amount You have paid for the Course. We shall not be liable for any indirect, consequential, or special losses, including loss of profit, income, or goodwill.

Governing Law and Jurisdiction

These Terms and Conditions and any disputes arising from or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any disputes arising under or in connection with this Agreement.

Data Protection and Privacy

We are committed to protecting Your privacy and complying with the General Data Protection Regulation (GDPR) and Data Protection Law. Any personal data collected from You will be processed in accordance with Our Privacy Policy, which can be found on Our website. By agreeing to these Terms and Conditions, You consent to the collection, use, and processing of Your personal data as outlined in the Privacy Policy.

Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by any court of competent jurisdiction, such provision shall be deemed to be modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted, and the remaining provisions of these Terms and Conditions shall remain in full force and effect.

Force Majeure

We shall not be liable for any delay or failure to perform any of Our obligations under this Agreement if such delay or failure is caused by events beyond Our reasonable control, including but not limited to acts of God, war, strikes, pandemics, natural disasters, or any other event considered as force majeure.

Amendments to the Terms

We reserve the right to amend these Terms and Conditions at any time. Any such amendments will be communicated to You via email or through Our website. It is Your responsibility to review the Terms and Conditions regularly. Your continued use of the Course following any amendments constitutes Your acceptance of the new terms.

Entire Agreement

These Terms and Conditions, together with any documents expressly referred to within them, represent the entire agreement between You and Nano Training concerning Your use of the Course and supersede any prior agreement, understanding, or arrangement between Us, whether oral or in writing. Each party acknowledges that, in entering into this Agreement, neither party has relied on any representation, undertaking, or promise given by the other except as expressly stated in this Agreement.

Assignment

You may not assign, transfer, or sub-license any of Your rights or obligations under this Agreement without Our prior written consent. We may assign, transfer, or sub-contract any of Our rights or obligations under this Agreement at any time without Your consent.

Notices

Any notice required or permitted to be given by You under these Terms and Conditions must be in writing and addressed to Nano Training at Our registered office or principal place of business. We may give notice to You at the email address You provide during registration. Notice will be deemed received and properly served immediately when posted on Our website, 24 hours after an email is sent, or three days after the date of posting any letter.

Waiver

No failure or delay by Us in exercising any right or remedy provided under these Terms and Conditions or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict Our further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.

Third-Party Rights

A person who is not a party to this Agreement shall not have any rights under or in connection with it by virtue of the Contracts (Rights of Third Parties) Act 1999.

Complaints and Dispute Resolution

If You have any complaints about the Course or Our services, You should contact Us via the contact details provided on Our website. We will respond to all complaints within 14 days. If a dispute arises under this Agreement that cannot be resolved through Our internal complaint-handling procedure, the parties agree to attempt to resolve the dispute through mediation before commencing any legal proceedings.
